Real Estate Law In Boston: Common Challenges And Solutions

Real estate transactions can be complex, and there are a number of different challenges that may arise for buyers, sellers or property owners in Boston. Some examples include:

  • Title disputes: These can arise when there are multiple owners on the title, such as when multiple beneficiaries have inherited a property together and need to work together to sell it. One owner may not have the authority to go through with the sale on their own.
  • Zoning or land-use regulations: If a property is not in the correct zone, there are sometimes legal remedies that can be used. One example is seeking a variance, which doesn’t change the zone but allows a property owner to break those regulations in this specific case.
  • Financing or closing delays: Delays in financing can sometimes happen when a buyer has preapproval but hasn’t yet gotten final approval. It could take the lender time to fully approve the loan, which may delay the transaction.
  • Boundary or property line disputes: The best way to resolve many boundary and property line disputes is simply to have a survey carried out. But this takes time, and there could be disagreements over the nature of the boundary dispute itself – such as who has the authority to trim tree branches or how far a fence needs to be set back from the property line.
  • Environmental or hazardous materials concerns: These are most common with industrial and commercial property transfers, where hazardous materials may need to be disposed of properly, or there could be concerns about renovating the real estate or using it differently than was originally intended.
  • Tenant-landlord disputes: Landlord and tenant disputes can take many different forms in both commercial and residential settings. For instance, commercial tenants may run into disagreements over the costs they face, such as who is responsible for paying property taxes, insurance or maintenance and upkeep costs.

These challenges can have significant consequences if not addressed, including delays or failed transactions, financial losses, damage to credit scores and strained relationships between both parties. They can make the transaction process much more complicated.

Our 275 years of collective experience handling these types of challenges are crucial in resolving them and seeking solutions. Our attorneys can provide guidance and counsel, answer pressing questions, conduct thorough research and due diligence, negotiate with all involved parties to resolve disputes, draft and review documents to ensure accuracy and compliance and represent clients in court or at regulatory hearings.

Often, through due diligence and research, we can head off potential disputes or complications and resolve them before they become an issue. If there are already disputes, we can use our deep legal knowledge to seek solutions, address local real estate laws and work through the process of negotiation or litigation.
